Chapter 3

After reading Chapter 3, "Concepts of Legal Philosophy," you should be able to:

  1. Describe how philosophies of law may relate to questions of law and morality and influence perceptions about law.
  2. Describe the six concepts of law.
  3. Explain the foundations of legal moralism.
  4. Articulate how Devlin interprets the six concepts of law and law's role in society.
  5. Explain the foundations of legal positivism.
  6. Articulate how Hart interprets the six concepts of law and law's role in society.
  7. Compare and contrast idealist theories of law, including legal naturalism, rights and interpretative jurisprudence, critical theories of law, and legal paternalism.
  8. Compare and contrast pragmatic theories of law, including legal realism and everyday pragmatism.
